In these Terms, "Platform" means Prime Properties, its website, applications, APIs, and related services. "User" means any visitor, registered member, or admin who accesses the Platform. "Content" means listings, messages, media, documents, and other material submitted to or displayed on the Platform.
By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you are using the Platform on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
You represent that all information provided during registration and thereafter is true, accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your credentials and for all activities conducted through your account, whether authorized by you or not.
Prime Properties operates as a moderated property marketplace that facilitates discovery, publishing, inquiry, and contact access between buyers, sellers, and users who may act in both capacities. The Platform may contain a public website, member-facing services, administrative tools, and third-party integrations.
All listings and user-submitted Content are subject to review, moderation, correction, rejection, removal, or suspension at our sole discretion. You agree that all Content you submit will be lawful, truthful, non-misleading, and not infringe any third-party right.
For sale listings may require photographs, supporting media, and a property PDF, while wanted-to-buy listings are treated as requirement posts and may be created without images or a PDF. Listing titles must not contain contact information, spam, or promotional material unrelated to the listing.
You grant Prime Properties a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, adapt, distribute, and process the Content you submit solely for the operation, maintenance, marketing, moderation, and improvement of the Platform.
Member-submitted listings are not guaranteed to become public and may remain pending until approved. Admin-created listings may be published immediately if valid. Sold listings may remain visible for a limited period before they are removed from public discovery, and visibility rules may change as the Platform evolves or as required by law.
Some features require payment, including but not limited to subscription access, contact unlocks, and post-sale success fees. All fees are payable in the amounts displayed on the Platform at the time of purchase, together with applicable taxes, gateway charges, and other levies where required.
Payment processing may be handled by Razorpay or another third-party payment provider. You authorize us and our payment providers to create, capture, verify, reconcile, refund, or cancel transactions as necessary to operate the Platform. Failed, expired, cancelled, or reversed payments may not confer access rights.
Public visitors may browse approved listings, but contact details remain hidden unless the applicable access conditions are satisfied. We may log inquiries, unlocks, payment references, device identifiers, and related activity for support, fraud prevention, audit, and legal compliance purposes.
You must not misuse the Platform, including by attempting to scrape, copy, benchmark, reverse engineer, interfere with, bypass, or exploit any portion of the Platform or its security, billing, or access controls. You must not submit unlawful, defamatory, misleading, harmful, obscene, or fraudulent material, or impersonate another person or entity.
Except for Content you submit, all right, title, and interest in and to the Platform, including its software, branding, layout, graphics, and documentation, are owned by or licensed to Prime Properties. No rights are granted to you except as expressly set out in these Terms.
The Platform may use or link to third-party services, including payment gateways, messaging providers, analytics tools, hosting, and app distribution services. We do not control third-party services and are not responsible for their acts, omissions, availability, or terms.
To the fullest extent permitted by law, the Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant that listings, user Content, availability, pricing, or identity information is complete, accurate, current, or error-free.
To the fullest extent permitted by law, Prime Properties and its affiliates, officers, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, data, business opportunities, or anticipated savings, arising from or related to your use of the Platform.
You agree to indemnify, defend, and hold harmless Prime Properties and its affiliates, officers, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your Content, your use of the Platform, your violation of these Terms, or your violation of any law or third-party right.
We may suspend, restrict, or terminate your access at any time, with or without notice, if we reasonably believe you have breached these Terms, posed a security or legal risk, or otherwise acted in a manner inconsistent with the intended use of the Platform. Upon termination, any rights granted to you under these Terms will cease immediately.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles, and any dispute shall be subject to the courts of competent jurisdiction, unless mandatory law requires otherwise.
We may revise these Terms at any time in our discretion. The updated Terms will be effective when posted unless a later effective date is stated. Your continued use of the Platform after any update constitutes acceptance of the revised Terms.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision shall not constitute a waiver of our right to enforce that provision or any other provision later.
